This Program Agreement between The Sales Leadership Academy Limited (trading as The Sales Coach) and our Client governs the provision of our High Performance Selling / High Performance Sales Leadership Programs. Last Updated Jan 14th 2025.

Program Plan

The program goals / desired outcomes and the session by session plan is captured in our shared workspace (Quip). 

The goals / outcomes and sessions can be changed by mutual agreement at any point during the program.

Program Delivery

The program is delivered as a series of (8x) sessions, conducted on a 1:1 basis (either in person or remote). Additional coaches may be involved in the delivery of the program but this will be agreed with the client in advance. Sessions are scheduled at monthly intervals. The Coach is also available outside the scheduled sessions (within reason) for consultation during the program.

A session focuses on a theme & topic (per the program plan), but the client can bring any topic to the session for coaching or discussion on an ad hoc basis.  A program review (to check-in and discuss progress) is conducted at the midpoint and can include a Sponsor if necessary. 

Roles, Responsibilities & Relationship

The Coach delivers the program to the best of their professional ability, in accordance with this Program Agreement and in compliance with our Code of Ethics. The Coach also commits to making themselves available for session scheduling and attendance.

The Client is responsible for scheduling program sessions. The Client acknowledges they are solely responsible for their own decisions, choices, actions and results arising or resulting from the program. As such, the Client agrees the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result from services provided by the Coach through the program.

Both Parties understand that to enhance the relationship and make the most of the program they will communicate in an open, honest way without judgement. They will create the time and energy to participate fully in the program. They agree to make every effort to attend, start on time, be fully present and free from distraction. They agree not to cancel or reschedule sessions unless unavoidable and to provide good notice of same.

The Sponsor is the individual representing the Client’s employers interests. Where present, the Sponsor reviews & agrees the program goals & outcomes together with the Coach & Client and attends review meetings if required.

Confidentiality

The relationship between the Coach and Client is bound by the principles of confidentiality as set forth in our Code of Ethics. The detail of what is shared is deemed to be confidential information and the Coach will not share it with any other party, whether verbal or written. 

Where a Sponsor is involved, the Coach will not disclose specifics without the Client’s consent. The Coach may recommend to the Client that they discuss something with the Sponsor, but it is the Client’s decision to do so. 

Confidential Information does not include information that: (a) was in the Coach’s prior possession; (b) is generally known in the Client’s business; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) the Coach reasonably believes there is likely risk of danger or harm to the Client or others; and (g) involves illegal activity. 

As a professionally accredited organisation, we engage in continued development pursuant to maintaining our professional credentials. To that end we may share your name, email and the program start and end dates with accrediting body staff members exclusively for the purpose of verifying the coaching engagement and they may contact you to verify the same. No other information is shared.

Term & Termination

The normal term for the program is 6 months. We allow up to 12 months to complete the program. Participation may be cancelled at any time, by agreement, with 1 weeks notice. Costs are prorated in this event.

Limited Liability

Except as expressly provided in this Agreement, The Sales Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the program services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount paid under this Agreement for all program services.
